1. Acceptance & Contractual Capacity

By accessing the Book Market AI platform, purchasing digital content, publishing manuscripts, or registering an account, you affirm that you are at least 13 years old, possess full legal capacity to enter into binding contracts, and agree unconditionally to these Terms of Service.

2. Square Merchant Processing & Commercial Terms

Commercial transactions on Book Market AI are governed by these merchant rules:

• Authorized Payment Methods: Payments are accepted via major credit cards, debit cards, Apple Pay, Google Pay, and Square-supported payment methods.
• Billing Authorization: By purchasing a digital book, physical print copy, or author membership ($3/month or $20/year), you authorize Square and Book Market AI to charge your designated payment instrument.
• Taxes & Duties: Buyers are responsible for applicable state sales tax, VAT, or GST calculated automatically at checkout based on delivery location.
• Chargebacks & Payment Disputes: Users agree to contact support@bookmarket.ai before initiating a payment dispute or chargeback with their card issuer. Fraudulent chargebacks result in immediate account termination.

3. Author Publishing Agreement & 100% Royalty Model

Authors maintain 100% copyright ownership and intellectual property rights in their works:

• Worldwide Distribution License: Authors grant Book Market AI a non-exclusive, worldwide, royalty-free license to host, encode, display, market, and distribute their books digitally (eBook) and physically (Lulu Direct Print-on-Demand).
• Author Royalties: Authors earn 100% net royalties on digital sales (sales price minus third-party payment processing fees and statutory sales tax). Royalties accrue in real-time in the Author Studio.
• Originality Guarantee: Authors warrant that all uploaded content is original, does not infringe on third-party intellectual property, does not violate copyright or defamation laws, and complies with platform content guidelines.
• Print Fulfillment (Lulu Direct): Physical book printing is fulfilled through Lulu Enterprises Inc. Print setup, trim sizing, cover finishes, and manufacturing costs are displayed transparently in the publishing modal.

4. Reader Digital Content License & DRM Controls

Purchasing an eBook grants you a personal, non-exclusive, non-transferable, revocable license to access and read the book through authorized Book Market AI reader software. Users agree not to copy, redistribute, extract, pirate, resell, or circumvent digital rights management (DRM) encryption.

5. Refund & Cancellation Policy

• Digital eBooks: Due to instant electronic delivery, eBook sales are final. Refunds are evaluated within 7 days of purchase only in cases of corrupt file delivery or verifiable technical failure.
• Physical Print Copies: Physical books are manufactured custom on-demand via Lulu Direct. Replacements or refunds are provided exclusively for physical manufacturing defects, damaged shipments, or lost packages reported within 14 days of receipt.
• Author Subscriptions: Author plans renew automatically. You may cancel at any time in your profile settings; cancellation takes effect at the end of the current billing cycle.

6. DMCA § 512(c) Copyright Notice & Takedown Policy

Book Market AI respects intellectual property and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe your copyrighted work is being infringed:

• Designated DMCA Agent: Legal & Copyright Department, Book Market AI
• DMCA Notice Email: dmca@bookmarket.ai (or support@bookmarket.ai)
• Notice Requirements: Provide physical/electronic signature, identification of copyrighted work, exact URL of infringing content, your contact details, a good-faith statement, and a statement under penalty of perjury.
• Repeat Infringer Policy: We maintain a strict policy of terminating the accounts of authors who repeatedly upload infringing content.

7. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, Book Market AI and its affiliates, officers, and directors shall not be liable for any indirect, incidental, consequential, special, or punitive damages. Users agree to indemnify and hold harmless Book Market AI against any claims arising from user content or violation of these Terms.

8. Governing Law & Dispute Resolution

These Terms are governed by applicable law without regard to conflict of law principles. Any dispute shall first be addressed through good-faith informal negotiation, and if unresolved, resolved through binding arbitration.
